For all legal and conventional purposes, the following is stated:

UPAGO is a company specialized in money collection and payment services, both online and in person, through its payment portal.

2.

The use of the Automatic Bill Payment System (PAT) implies the user's acceptance of these terms, the privacy policy, and any other information, document, agreement, or act referenced in this document.

3.

Clients of businesses that are part of UPAGO may, through the corresponding payment portal of the associated company, link and register their credit and debit cards to automate payments with a single click. They may also activate accounts associated with a business so that payments are made automatically through PAT, granting the corresponding mandate and authorization under the terms set forth in this document.

4.

To implement the previous point, the client must log in and authenticate themselves in the payment portal using their RUT (Chilean Tax ID) and password or register through a sign-up form to gain access. This form will include the following data: First Name, Last Name, Email Address, RUT, Password, and Password Confirmation, and acceptance of these Terms and Conditions via a button.

Registration is strictly individual, meaning no client is authorized to use another person's data or accounts. UPAGO reserves the right to block or delete a client found engaging in such activity, without prejudice to any legal action that may be taken, as such conduct may constitute a crime.

Upon logging into their account, as stated in point 4, the client must first register one or more debit or credit cards using the “Register New Card” option. They must then link their accounts for automatic payment with a previously registered credit or debit card of their choosing, in accordance with the PAT service.

7.

Once accounts are linked, the user will receive a confirmation email verifying the PAT association, detailing the linked cards and accounts.

8.

In the event of account or card removal, the user will be notified by email, following the procedure described in the previous point.

9.

Accounts are associated with Chilean Pesos, and all monetary transactions or references within the service shall be understood to be in the legal currency of the Republic of Chile.

10.

The user is solely responsible for maintaining the confidentiality and security of their password. UPAGO will not be liable for any misuse of its services by the user or third parties, without prejudice to any legal action that may be pursued for damages suffered by the user or its clients, in accordance with the remedies available under the law.

11.

UPAGO is not responsible for errors made by the user when associating credit or debit cards or accounts. Nor is it responsible for incorrect data entered by the user during registration, including but not limited to identity mismatches, typographical errors, or incorrect email addresses.

12.

The user may delete their account at any time, following the procedures established on the website. Likewise, UPAGO reserves the right to delete or suspend accounts found to be in violation of these terms and conditions.

13.

The use of the service is always the sole and absolute responsibility of the user. UPAGO does not guarantee the availability or continuity of site operations when issues arise from third parties, force majeure, or unforeseen circumstances. UPAGO is not liable for telecommunications network failures, equipment malfunctions, viruses, or any application that causes harm to the user's system or assets. UPAGO is exempt from liability in cases of force majeure or unforeseen events.

Any manipulation of the website, including content, logos, intellectual property rights, or trademarks, is strictly prohibited.

15.

The use of UPAGO services for illegal, fraudulent, or illicit purposes is strictly prohibited. UPAGO reserves the right to delete or suspend accounts found to be using PAT for such purposes, without prejudice to taking legal action against those responsible.

All information entered by the user on the website is protected under Law 19.628 (Chilean Data Protection Law).

The intellectual and industrial property rights of products, logos, trademarks, codes, and all data, information, creations, goods, or services, including those listed as examples, belong to UPAGO. No individual or legal entity may use them without prior written authorization from a representative with the authority to grant such permission.

UPAGO reserves the right to modify, remove, amend, or correct any information contained on its website, including but not limited to rates, services, and conditions, at any time and without prior notice to users.

19.

UPAGO will provide users with contact channels (phone, online, or written) to submit feedback, complaints, and inquiries. The user agrees to use these channels correctly, respectfully, and professionally when communicating their opinions. Likewise, UPAGO commits to responding to urgent requests as soon as possible.

20.

The governing law applicable to these terms and conditions is that of the Republic of Chile. Any contractual or non-contractual disputes that cannot be resolved through UPAGO’s available channels will be resolved by ordinary Chilean courts.
